DA Issues Statement Re: Target Altercation Involving Juveniles

On March 25, 2025, the Fresno County District Attorney’s Office declined to file charges against the juveniles involved in the altercation that occurred on March 23, 2025, involving Herculano Tucay at the Target located on Shaw and Clovis Avenues.

The decision not to file charges was made after a thorough review of the criminal investigation and a careful evaluation of the evidence presented by the Clovis Police Department. This review included an examination of police reports, body-worn camera footage, and store surveillance video. The surveillance footage confirmed that this was a case of mutual combat. Both Mr. Tucay and one of the juveniles sustained significant injuries during the unfortunate disturbance. Following this comprehensive review, the District Attorney’s Office determined that the evidence did not meet the legal standard required to support criminal charges.

Due to confidentiality laws regarding juveniles, the District Attorney’s Office is prohibited from discussing the details of the matter.

“While our office does not typically issue press releases when declining to file charges, we did so in this case due to the extraordinary public interest,” said District Attorney Lisa Smittcamp. “We want to assure the community that this decision was made after a meticulous review of all available evidence and in accordance with the law. The Fresno County District Attorney’s Office remains committed to ensuring that all cases are evaluated fairly and based solely on the evidence and the law.”
