The Fresno County District Attorney’s Office has filed charges against David Gonzalez III, (32, of McAllen, Texas), in connection with an alleged assault on a 72-year-old Tower District homeowner and the homeowner’s daughter on the morning of Friday, October 9, 2026.
It is alleged that Gonzalez was found sleeping on the front lawn of the homeowner’s residence during the early morning hours. When the homeowner went outside to ask Gonzalez to leave, Gonzalez assaulted him, causing him to fall to the ground and sustain visible injuries.
During the incident, Gonzalez also threw the victim into a neighbor’s parked vehicle, causing significant damage to the side of the car. When the homeowner’s daughter intervened to help her father, Gonzalez assaulted her as well, causing her to fall to the ground.
Fearing for his safety and the safety of his daughter, the homeowner fired one (1) round from a firearm he legally possessed, striking Gonzalez. Gonzalez was taken into custody by the Fresno Police Department and transported by ambulance to a hospital for medical treatment.
The Felony Complaint filed in Fresno County Superior Court alleges that Gonzalez committed the following offenses:
• One (1) Count of ASSAULT BY MEANS LIKELY TO PRODUCE GREAT BODILY INJURY (Penal Code § 245(a)(4));

• One (1) Count of VANDALISM (Penal Code § 594(b)(1)); and
• One (1) Count of BATTERY (Penal Code § 242).
If convicted of all charges and allegations, Gonzalez faces a maximum sentence of four (4) years and eight (8) months in custody.
Gonzalez was arrested by the Fresno Police Department on October 9, 2026, and remains in the hospital where he is in custody receiving medical treatment. Based upon the charges filed, the scheduled bail amount is $52,000. His arraignment is scheduled for Wednesday, October 14, 2026, at 8:30 a.m. in Department 31 of the Fresno County Superior Court.
